Welcome to antiquitymusic.com (the “Site”), the web-based division for Antiquity Music, LLC (hereinafter referred to as "Antiquity Music" or “antiquitymusic.com”). Antiquity Music, LLC and its wholly-owned subsidiaries provide their services to you subject to the following terms and conditions (hereinafter "Terms and Conditions", “Terms of Use”, or "Agreement"). All purchases, licenses, and uses of software and sounds recordings, and of any related media/documentation/materials (for example program manuals), manufactured by Antiquity Music are governed by the Antiquity Music End User License Agreement ("EULA"), the terms of which are incorporated herein for those specific purposes only. All purchases of Wheelharps are governed by the Wheelharp Terms & Conditions, the terms of which are incorporated herein for those specific purposes only. All rentals of musical instruments are governed by the Rental Terms & Conditions, the terms of which are incorporated herein for those specific purposes only. This Agreement may not be altered, supplemented, or amended by you through the use of any other document(s). An attempt to alter, supplement, or amend this document or to enter an order for product(s), which is subject to additional or altered terms and conditions, will be null and void, unless otherwise agreed to in a written agreement signed by both you and Antiquity Music. These Terms of Use are subject to change by Antiquity Music, LLC at any time in its discretion. Your use of this site after such changes are implemented constitutes your acknowledgment and acceptance of the changes. PLEASE READ THESE TERMS OF USE CAREFULLY. BY ACCESSING THE SITE, OTHER THAN TO READ THESE TERMS OF USE FOR THE FIRST TIME, OR BY PURCHASING PRODUCTS OR SERVICES FROM THE SITE, YOU AGREE TO BE BOUND BY AND ACCEPT THIS AGREEMENT. IF YOU DO NOT WISH TO BE BOUND BY THESE TERMS AND CONDITIONS, YOU MAY NOT ACCESS OR USE THIS SITE. Please consult these terms of use regularly and carefully. antiquitymusic.com and its affiliates attempt to be as accurate as possible. However, antiquitymusic.com does not warrant that product descriptions or other content of this site is accurate, complete, reliable, current, or error-free. We make every effort to accurately represent items, but you agree that differences in color are typical across computer viewing screens and printers, and that these differences in color are not grounds for a refund, other than those allowed by the official antiquitymusic.com refund policy as it pertains to non-defective items. See paragraph 7 above.
Unless otherwise clearly noted on the specific item’s product page, all new items sold by Antiquity Music, except for Antiquity Music's own branded sample library products, are sold with the manufacturer's limited warranty and are warranted solely by the manufacturer or distributor. All items needing repair, except Antiquity Music's own branded sample library products, should be sent directly to the manufactuer or distributor for service or be sent according to the instructions in the manufacturer's or distributor's warranty. Antiquity Music will not be liable if the manufacturer or distributor fails to perform warranty service or provide a refund.
ANTIQUITY MUSIC PROVIDES NO SEPARATE WARRANTY AND TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ANTIQUITY MUSIC EXPRESSLY DISCLAIMS ALL WARRANTIES AND CONDITIONS REGARDING ANY PRODUCTS SOLD TO YOU, WHETHER EXPRESS, IMPLIED OR STATUTORY, AND INCLUDING BUT NOT LIMITED TO ALL WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON–INFRINGEMENT OF THIRD PARTY RIGHTS.
Antiquity Music will not be responsible for any consequential or incidental damage resulting from the sale or use of any merchandise purchased from us. Antiquity Music's liability is limited to the monetary value of the merchandise.
16. Sales Policy, Payment Terms and Sales Tax Back to Top
Unless otherwise clearly noted on the specific item’s product page, all products listed as "New" at antiquitymusic.com are brand new and carry the full manufacturer’s warranty, which varies completely from manufacturer to manufacturer, and even from product to product. Please note that Antiquity Music's own branded sample library products do not carry a manufacturer's warranty. All warranty claims are between you and the original manufacturer of the good, and shipping costs for warranty items are the responsibility of the customer. Items that you receive DOA (dead on arrival), that fail, or that are otherwise determined defective, within the first thirty (30) days after arrival, may alternatively be handled through the below Return Policy. Except as otherwise provided by the manufacturer warranty agreement, you are responsible for any shipping costs to and from the manufacturer for warranty repairs. All returns and cancellations are subject to this entire set of Terms and Conditions, including the below Return Policy and its provisions concerning special order items.
We require prepayment cleared in full before any goods will leave our facility, and reserve the right to cancel any order and return payment at any time and for any reason. Cleared prepayment includes payment by cashier's check, money orders, personal checks, bank wires, or credit card prepayments that have gone through any security steps deemed necessary by antiquitymusic.com to prevent fraud.
The following terms apply to the these payment methods, all of which are acceptable payment methods:
1. CHECKS: All checks (including cashier’s checks and money orders) must clear before any orders or merchandise can be sent out. There is a 5–7 business day hold placed on all checks received. Payment must be received within three business days by us. Time is of the essence.
2. BANK WIRE TRANSFER: Bank details will be provided upon request. We cannot ship until bank wires have been confirmed and funds have been received by our banking institution. Please fax us a copy of the wire transaction provided by your bank to speed up this process and help track your incoming wire. E-mail sales@antiquitymusic.com for bank wire details. Payment must be received within three business days by us. Time is of the essence.
3. CREDIT CARD: We accept VISA, MasterCard, American Express, DIscover, and Paypal. We can only ship your order to addresses verifiable by your issuing credit card bank. Please be sure to provide your exact billing address and telephone number which are the same as your credit card issuer has on file for you. Incorrect information will delay the processing of your order.
Credit card payments will be processed for the full amount before any labor is performed on used and vintage items. Antiquity Music retains the right to refuse credit card purchases at any time and is subject to Antiquity Music's approval. Credit card charges for larger transactions may be denied and could require an alternate payment method. Antiquity Music also retains the right to charge any customer credit card on file to pay for overdue accounts.
4. ECHECK: We provide eCheck as a payment option through PayPal. There is a 5–7 business day hold placed on all domestic eChecks received, and a 6-10 business day hold placed on all international eChecks received.
Cash is not a payment option that we accept at this time.
With the exception of Wheelharp orders, all orders are subject to 1% interest charge per month and to a monthly storage charge of $3 (three dollars) per square foot of floor space taken up by the instrument if the order not paid for within terms or not picked up within one month of completion of payment, unless otherwise expressly agreed to in writing by Antiquity Music.
If required by applicable law, you will be charged for applicable sales tax on your purchase. A separate charge for these taxes will be shown on the invoice. antiquitymusic.com is required to collect sales tax for items delivered to addresses in California or for items that are picked up from our location. If we ship to your address in California, we must collect sales tax from you. We make no claims as to whether you may be liable for sales or use tax in the country or state to which the product is shipped.
The care required in repairing, restoring, and maintaining rare and arcane instruments and other music technology is very expensive; the unique sonic possibilities and resulting value that our instruments provide in sample library format pays for much of that upkeep. Thus, wholesale, “note-by-note”, or commercial sampling of the instruments that we sell is discouraged, as it negatively impacts our own sample library products. For purposes of this agreement, “Sample Library” is defined as a collection of digital sound recordings of a musical instrument, for use by composers, arrangers, performers and producers of music, similar to those created by companies such as East West / Quantum Leap, Sonic Impact, Sonic Reality, Sonic Couture, 8dio, and the like. In conjunction with any item you buy from antiquitymusic.com, unless both you and antiquitymusic.com expressly agree otherwise, you agree that you will not conduct “wholesale”, "note-by-note", or commercial sampling of the instrument or another model of the same instrument, nor rent/lease it, nor knowingly make it available to anyone associated with a sample library company or that you reasonably should know is associated with a Sample Library company, nor compete with our Sample Library products in any other manner related to producing your own or another entity’s Sample Library with the instrument or another model of the same instrument. For the avoidance of doubt, you shall not create, distribute or disclose any Sample Library featuring the instrument or another model of the same instrument without the written permission of Antiquity. If you do make such a Sample Library or knowingly make the instrument available to anyone associated with a sample library company who or which thereby makes a Sample Library with said instrument or another model of the same instrument, you hereby agree that such Sample Library shall be a "work made for hire” (as defined under the U.S. copyright laws) and a contribution to a collective work, and that, accordingly, Antiquity Music owns all United States and international copyrights and all other intellectual property rights in it. Antiquity Music is and will continue to be the owner of any content designed or developed by you for this Sample Library featuring this instrument. You agree to assign, and upon creation of each element of each Deliverable automatically assign, to Antiquity Music, its successors and assigns, for good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, ownership of all United States and international copyrights and all other intellectual property rights in each element. You further agree to execute any documents necessary to evidence the transfer of ownership to the Antiquity Music and have any other individual who is associated with a sample library company sign a printed copy of this Agreement, indicating that they agree to these Terms and Conditions.
You represent and warrant that if you are purchasing something from us that (i) any credit information you supply is true and complete, (ii) charges incurred by you will be honored by your credit card company, and (iii) you will pay the charges incurred by you at the posted prices, including any applicable taxes. You agree that you shall be responsible for any collection fees or other legal fees associated with any failure to pay or fraudulent representations.
17. Shipping, Damaged or Lost Goods, Inspection, Acceptance Back to Top
Separate charges for shipping and handling will be shown on your order form. Choice of transportation, carrier, shipping method and route shall be at antiquitymusic.com's election unless specified by you in writing immediately before or immediately after payment; you agree to pays any difference in cost. As a security precaution, initial orders and orders shipping to alternate addresses may be held for extended verification. We reserve the right to make partial shipments, which will not relieve you of your obligation to pay for the remaining deliveries. You shall pay all freight, handling, packing, delivery, insurance, brokerage, tax, duty and other charges which may incur during shipments of goods, unless otherwise agreed between antiquitymusic.com and you.
Without limitation, Antiquity Music is not repsonsible for any duty, VAT, or additional taxes that may be charged after the sale. These additional charges may be charged when you pick up the item at customers or during delivery. It is the sole responsibility of the international customer to check local regulations when buying exported goods. These fees are not included in any product or shipping chrages.
Unless otherwise specified, all items purchased from Antiquity Music are made pursuant to a shipping contract, with shipping terms Ex Works. That means that risk of loss, damage, or title to the shipped goods shall pass to you upon our delivery of the goods to the carrier, or in the case of services, when services are completed. Services by antiquitymusic.com shall be deemed to be completed/performed in full when the goods upon which services have been performed are delivered to carrier. Any claims resulting from goods lost or damaged in transit, or claims of shortages received or of shipment tampering must be filed by you exclusively with the carrier. In order to protect you, antiquitymusic.com requires that every shipment be insured by the carrier used to fulfill your order, unless otherwise specified. Insurance costs are not included in order totals which take place online and will be added when your order is processed at 70 cents ($0.70) per $100. If an item is lost or damaged by the carrier while under the carrier's control, antiquitymusic.com will make every reasonable effort on your behalf for a speedy recovery of insurance proceeds, lost items, or product replacement if so desired by you. While this policy explains antiquitymusic.com's efforts on your behalf, the shipping insurance claim process and any other aspect of the shipping contract is governed by the shipping contract with the individual carrier, and not with antiquitymusic.com.
We take great care to prevent damage from occurring and pack shipments so that they will arrive safely. You should NOT immediately sign for a package if you suspect that the contents have sustained damage during shipment. Rather, in that instance, either simply refuse the package, require that the delivering agent allow you to inspect the package’s contents and approve their condition, or require the delivering agent to note damage to any packages on the release form and sign it (if applicable), prior to you signing for any package. Notify us immediately so that we may work with you to arrange and expedite an insurance claim. As described below, antiquitymusic.com is not responsible for any denied shipping claims. Signing for a package does not necessarily eliminate your ability to file an insurance claim, but it might significantly limit the viability of an insurance claim, as all items are subject to the shipping contract provided by the carrier that you choose. If you have accepted or signed for the package, you must keep the damaged item(s), all packaging material and the original shipping container until the insurance claim process has been completed, or your insurance claim will likely be refused.
Immediately upon receipt of the items, you agree to diligently inspect and/or test them. Even if you are giving item as a gift, we kindly ask you to inspect all packages before giving them away. After inspection, the items shall be deemed accepted by you unless you provide antiquitymusic.com a timely written notice specifically noting any defects or discrepancies in the quality or quantity of items received. If a good’s nonconformance is NOT due to treatment incurred during shipment, notices regarding nonconforming goods, rejection or revocation of acceptance must be made in writing and received by antiquitymusic.com, and the item must be sent back no later than 14 days from the date of arrival, which you agree is a reasonable time frame within which to diligently inspect and provide notice to Seller. You waive any right to revoke acceptance thereafter.
As described below, with any returned purchase or if you refuse shipment without any legal excuse, we may opt to recover a restocking fee consisting of 20% of the total price plus all freight and handling charges. Notwithstanding the foregoing, if we reasonably suspect bad faith on your part, we may refuse the return of goods and seek our remedies under applicable law. You shall pay all extra routing charges for any re-route shipment incurred by your instruction or your provision of incorrect shipping information including, but not limited to, wrong address or wrong freight collect information.
If you desire a replacement while awaiting the results of an insurance claim with the shipping carrier, and a replacement is available, the replacement will be shipped at no additional cost to the customer once the defective item has been returned to antiquitymusic.com or the product manufacturer and is verified to be in the above stated condition. However, you will be responsible for payment of any advance replacement prior to receipt of any insurance proceeds from the shipping carrier. Should antiquitymusic.com handle an insurance claim on behalf of you, or should the carrier send the insurance proceeds to antiquitymusic.com, antiquitymusic.com will promptly refund the money for the original purchase price, once it successfully resolves an insurance claim and receives the full insurance proceeds from the insurance adjustment.
If a package is undeliverable or if an address needs to be corrected due to a customer error, the customer will be responsible for all incurred fees. Please make sure to provide an accurate shipping address when placing your order.

Summary
If there is a problem with your order or you are not completely satisfied, simply return it in its original condition within 30 days of purchase (see exceptions below) and we'll give you a full refund. The following return policy shall apply to all items purchased from antiquitymusic.com or by phone, email, or direct communication with an Antiquity Music representative, subject to exceptions below. If for some reason you are not satisfied with a particular clause of this return policy, or would like to request a special exemption from an aspect of the policy, you must request specific written approval of any deviation from this policy by an agent of antiquitymusic.com before completing your purchase. If you do not receive an exemption from any part of the return policy, you shall be bound by this return policy as it is stated here. Special return procedures may be granted such as "demo" period or "approval" period, but these are deviations from the normal return policy that must be granted by an antiquitymusic.com agent, in writing, prior to any purchase. We do not allow refunds for damaged, marked, or misused items, items that have been altered, modified, tampered with, items that are missing documentation or packaging, nor items that deviate in any other way from perfect, as-new condition.
For all returns of items that are returnable per our our policies above and below, you must follow the below instructions:
1. First, contact us so that we can provide a Return Authorization (RA) number. You can reach Antiquity Music customer service Monday through Friday from 10AM and 7 PM Pacific Time. Email sales@antiquitymusic.com or call 1.310.439.2643. All items returned must be given a return authorization (RA) number by an antiquitymusic.com employee.
2. Second, place the Return Authorization (RA) form provided inside the box(s) of your return shipment. We can only accept returned products in their original packaging and in the exact same condition in which it was shipped.
3. Third, amply pack the item very carefully (you should have at least the original packaging and packing material anyway, and you should provide supplementary packing materials if the outer carton has been worn during the original trip out to you) and ship the package using a shipping method with a tracking number, insured for the value of your purchase in the event of theft or damage, to the following address:

You are solely responsible for your purchase until your return arrives at our premises. Please email sales@antiquitymusic.com with your tracking number so that we know when to expect the package, and have your tracking number available in case you have any questions for us.
For International Returns, in addition to obtaining a RA number, Antiquity Music will provide customs and shipping documents that must be used. Failure to use these documents and instructions may result in additional duties or taxes, which will be your responsibility.
You may return any non-defective regular-stock item to us for a full refund of the original purchase price if the packaging remains unopened and sealed. If you return any such item for any reason, even if defective, it must be returned within 30 days of receipt and in original, brand-new condition, with it and all original packaging, documentation (including owner's manual, warranty card, software, guides, etc.), accessories, and other materials intact and showing no signs of wear or use such as belt-buckle or pick scratches, scuffs, dings or scrapes. Returned items must also include original packaging, manuals, warrantees, and accessories. For all returns of non-defective regular-stock items of which packaging has been opened or seal broken, but otherwise meet the foregoing conditions, Antiquity Music reserves the right to charge a restocking fee of 15%. There are no refunds on any items that do not meet these conditions or that have been tampered with. Used, vintage and demo items (none of which are regular-stock items, of course) are subject to a 5% processing/restocking fee if cancelled before delivery, and are non-returnable after delivery. You will be responsible for the shipping or other transportation (and associated insurance) charges both ways, including but not limited to rerouting charges, even if your purchase was eligible for free shipping. In other words, refunds are made for product value only, excluding shipping and handling charges. If you received Free Shipping on your order, the value of the uncharged shipping cost will be deducted from your refund. You will be refunded the remaining balance after antiquitymusic.com has inspected the item and the item satisfies the foregoing conditions.
antiquitymusic.com will waive the restocking fee, but not the shipping charges, if the item is a regularly stocked item and you are willing to use the complete credit towards another purchase at antiquitymusic.com. This option will only be possible if the condition of the returned item meets the above conditions. If you are uncertain as to whether or not an item is regularly stocked at antiquitymusic.com, you must confirm such information by contacting us prior to placing an order.
Our return policy is in place to ensure our customers never get stuck with a wrong piece of gear. Those who violate the spirit of our return policy by having excessive returns may be subject to limitations or suspension of return privileges.
Exceptions to the 30-day return period
While most non-defective regular-stock items are available for return, no returns are allowed for the following:
- Software
- Computers, computer-related hardware, and all Apple hardware
- Oversize or over-weight items (i.e. freight-size or larger/heavier)
- Personal items (earphones, headphones, windscreens, microphones, etc.)
- Books, CDs, and videos
- Tubes, turntable cartridges,
- In ear buds, earplugs and in ear monitors
- Clearance items and discontinued items
The return period is limited to only fourteen (14) days for recording and DJ equipment, workstation keyboards, and rack signal processors, that are non-defective regular-stock items.
If an item is “special order”, it will be designated as such by an antiquitymusic.com agent when you order or shall be clearly marked “Special Order” on the antiquitymusic.com website. If an item is labeled “Special Order”, it is a new item that is not regularly stocked nor regularly held in our inventory (and hence is not a "regular-stock" item), or is not stocked, out of stock or discontinued. Thus, it will be NONRETURNABLE, no matter what reason might be given. In other words, when a customer requests a Special Order, we act as an agent for a customer in locating or ordering a particular item or items. Upon customer e-mail approval, we reasonably rely on that customer’s order by forwarding payments to another dealer, distributor, builder, manufacturer or other third party in order to secure the item(s) for the customer. For this reason, once an order is placed for a Special Order Item, these orders are also NONCANCELLABLE. If a "Special Order" item is received by the customer with a material defect, antiquitymusic.com will work with the client to resolve the issue with the manufacturer or third party, if applicable, and will repair or replace the item, depending on the manufacturer's decision, if applicable. If the manufacturer or third party issues a refund to antiquitymusic.com for the defective special-ordered product, these refund proceeds will be made available to the customer at the customer’s option.
Defective items
Any defective item shall be fully refundable with any associated shipping costs. antiquitymusic.com may require that you ship the item directly to the manufacturer, as all new items sold by Antiquity Music are warrented solely by the manufacturer or distributor and not by Antiquity Music. You shall contact antiquitymusic.com immediately regarding any potential defects that you might find. As mentioned, you must receive an RA (Return Authorization) for any item that is returned to antiquitymusic.com. A full refund or replacement product will be issued only after the item has been verified defective, to be determined in Antiquity Music's sole discretion. In order to qualify for a refund or replacement, it must be returned within thirty (30) days of receipt and in perfect as-new condition, with all original packaging, documentation (including owner's manual, warranty card, software, guides, etc.) accessories, and other materials intact, notwithstanding the defect. There are no refunds on any items that do not meet these conditions or that have been tampered with, have signs of wear or use, or are without original carton. You must follow the above three-step instructions (described in the “regular-stock items” section) and satisfy all other aforementioned general conditions in order for your return to qualify for a refund.

19. Pricing, Price Quotes, and Stock Policy Back to Top
While we try our best to maintain accurate product pricing, description, availability information, Antiquity Music does not warrant the accuracy or completeness of the information provided on the Site, including but not limited to price or stock status. Some items on our site may be incorrectly priced or may sell out prior to the website updating or even after an item has been added to your cart, and therefore we cannot confirm the price or availability of an item until after we receive your order. For instance, in some cases pricing may have been entered or computed in error, and sometimes we will not be aware of a change in price, availability, or backorder time estimates because we were not informed by the manufacturer or supplier about it. Also, Antiquity Music may make changes to information on the Site, including to the products and prices described, at any time, without prior notice to you. By visiting the antiquitymusic.com site, you understand and agree that prices and availability are subject to change, and that Antiquity Music or its service or product providers shall not be liable to you in any manner whatsoever for any decision made by you, or for any act or failure by you, in reliance upon information provided at this Site. We reserve the right to refuse service to anyone. Antiquity Music will indicate its acceptance of an order by acknowledging your order by reply email or by shipping the ordered items to you. If a product that you purchase does nto match the description on the Site, as your sole and exclusive remedy you may return the product, unused, to Antiquity Music and receive a refund of your purchase price. As unlikely as it might be, you also agree that when you place an order, antiquitymusic.com reserves the right to decline your order and refund any payment received if your order was placed at an incorrect price or for an item that has become unavailable. If for any reason an item's correct price is higher than our stated price or if the availability or stock situation differs materially from that which is stated on the website at the time you place an order, we will contact you in order to provide you with the opportunity to cancel the order or to receive your instructions and confirmation prior to fulfilling your order.
Items in your shopping cart will reflect the most recent price displayed on the item's product detail page. Prices are frequently updated to adjust for different sales, limited pricing, and other discounting. Therefore, prices on the product detail page and in your cart may change after such updates to reflect the current prices. Placing items in your cart does not reserve the current prices shown at that time, and prices are reserved only by placing an order. From time to time, despite our efforts, a small number of the items on our website may be mispriced. We apologize for any inconvenience. If you are not satisfied with your purchase due to any errors or inaccuracies, you may return it in accordance with our return procedure. Discounts are limited-time offers and are not valid with other offers.

Price quotes may not be requested by our competitors , nor used in any way to seek price quotes from our competitors, which include. By requesting a price quote from our site, you agree that you are a legitimate potential customer asking for pricing information in anticipation of potentially purchasing the item at issue from antiquitymusic.com. All price quotes are subject to change.
Some products, including but not limited to those identified as Closeouts, Clearance Items, and Limited Quantity items may be limited to stock on hand and are offered on a first come, first served basis.

ANTIQUITY MUSIC DOES NOT ACCEPT LIABILITY BEYOND THE REMEDIES SET FORTH HEREIN, INCLUDING ANY LIABILITY FOR PRODUCTS NOT BEING AVAILABLE FOR USE OR FOR LOST OR CORRUPTED DATA OR SOFTWARE, OR THE PROVISION OF SERVICES AND SUPPORT. ANTIQUITY MUSIC WILL NOT BE LIABLE FOR LOST PROFITS, LOSS OF BUSINESS OR OTHER CONSEQUENTIAL, SPECIAL, INDIRECT, OR STATUTORY DAMAGES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. YOU AGREE THAT FOR ANY LIABILITY RELATED TO THE PURCHASE OF PRODUCTS OR SERVICES BUNDLED WITH THE PRODUCTS, WHETHER FOR BREACH OF CONTRACT, WARRANTY, NEGLIGENCE, STRICT LIABILITY IN TORT OR OTHERWISE, ANTIQUITY MUSIC SHALL NOT BE LIABLE OR RESPONSIBLE FOR ANY AMOUNT OF DAMAGES ABOVE THE AGGREGATE DOLLAR AMOUNT PAID BY CUSTOMER FOR THE PURCHASE OF PRODUCTS OR SERVICES UNDER THIS AGREEMENT GIVING RISE TO SUCH LIABILITY. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you if the law of such jurisdiction applies.

This Agreement shall be deemed executed and delivered in the State of California and shall be governed by and construed and enforced in accordance with the laws of the State of California, without regard to conflicts of law provisions.

The arbitrator’s award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise.
